Suruhanjaya Diraja bagi Menyiasat Klip Video Linggam.

Perdana Menteri mengumumkan perlantikan Suruhanjaya Diraja bagi Menyiasat Klip Video Linggam;

Bidang tugas suruhanjaya itu ialah untuk menyiasat dan menentukan kesahihan rakaman klip video berkenaan, menyiasat dan mengenal pasti identiti orang yang dalam klip video itu selain dengan siapa dia sedang bercakap, dan semua orang yang disebut dalam perbualan itu.

Ia juga akan menyiasat dan menentukan kebenaran isi kandungan percakapan dalam klip video itu, menentukan sama terdapat sebarang salah laku oleh orang atau mereka yang dikenal pasti atau disebut dalam klip video itu, dan, mengesyorkan tindakan terhadap orang atau mereka yang dikenal pasti atau disebut dalam klip video itu sekiranya mereka ini didapati telah melakukan salah laku.

Abdullah berkata suruhanjaya itu diberi tempoh tiga bulan mulai hari ini untuk menyiapkan siasatan dan mengemukakan satu laporan kepada Yang di-Pertuan Agong.

ANWAR DEDAH BUKTI KONSPIRASI

Anwar dedahkan bukti kospirasi dalam sistem kehakiman


anwar-pc.JPGKUALA LUMPUR, 19 September - Ketua Umum KeADILan, Anwar Ibrahim mendedahkan terdapatnya konsiprasi dalam sistem kehakiman negara melalui satu tayangan video di rumah beliau hari ini.

Video tersebut merakam aksi perbualan VK Lingam melalui telefon di rumahnya dengan Ketua Hakim Negara, Ahmad Fairuz Abdul Halim pada tahun 2002.

Pada ketika itu Ahmad Fairuz merupakan Ketua Ketua Hakim Malaya iaitu orang nombor tiga dalam hierarki badan kehakiman negara.

Menurut Anwar, rakaman video tersebut jelas membuktikan bahawa proses perlantikan hakim-hakim kanan penuh dengan skandal rasuah dan penyelewengan.

“Ini juga membuktikan bahawa pelantikan tersebut turut mempengaruhi hasil-hasil dalam sebilangan prosiding kehakiman termasuk kes saya,” tegasnya.

Beliau menegaskan bahawa melalui video tersebut Lingam turut menyebut nama Vincent Tan dan Tengku Adnan Tengku Mansor dalam perbualannya.

“Vincent Tan merupakan seorang ahli perniagaan dan hartawan perjudian yang terlibat dalam penyalahgunaan proses kehakiman yang kini dikenali sebagai kes Ayer Molek,” jelasnya.

Manakala, ujarnya, Tengku Adnan adalah pemimpin Umno dan juga ahli Kabinet yang salah seorang terlibat dalam kospirasi politik untuk memecat beliau sebagai Timbalan Perdana Menteri pada tahun 1998.

“Dalam video ini VK Lingam dapat dilihat dan didengar bercakap dengan Ketua Hakim Negara (sekarang) Ahmad Fairus di mana nama saya dan Wee Chee Keong di antara lain disebut secara khusus,” katanya.

Anwar juga memberitahu bahawa pada tahun 1994, gambar Lingam bersama bekas Ketua Hakim Negara, Eusoffe Chin sedang bercuti di New Zealand boleh menimbulkan beberapa persoalan tentang sikap, politik dan etika peguam itu yang memberi implikasi kedududakan dan kewibawaan Ketua Hakim Negara ketika itu.

“Lingam juga terlibat dalam kes laporan ‘Pricewaterhouse Coopers’ yang dibentangkan oleh saya dalam Parlimen pada tahun 1995 berikutan satu siasatan audit yang lengkap Perwaja menguatkan skandal yang melibatkan kerugian berbilion ringgit,” katanya.

Menurutnya lagi, pendedahan skandal tersebut akan mengesahkan apa yang KeADILan yakini sebelum ini bahawa terdapatnya konspirasi di peringkat tertingi dan rasuah besar yang melibatkan badan kehakiman.

Beliau berkata bahawa konspirasi tersebut antara lain memberi kesan kepada keputusan badan kehakiman yang dikatakan menganiaya orang yang tertentu.

“Ini melibatkan kepentingan awam dan kita desak kerajaan tubuhkan tribunal bebas untuk siasat skandal yang mengaibkan ini,” katanya.

Beliau juga berkata akan mengusulkan isu itu kepada Presiden KeADILan, Dr Wan Azizah Wan Ismail agar menemui Majlis Raja-raja Melayu bagi menyerahkan video tersebut.

“Pertemuan itu adalah untuk memohon Majlis Raja-raja Melayu supaya menjalankan tanggungjawab mereka menurut perlembagaan agar badan kehakiman kekal bebas,” tegasnya.

Sementara itu, Naib Presiden KeADILan, Sivarasa Rasiah memberitahu video tersebut turut akan dibawa ke Majlis Peguam Negara supaya boleh diteliti secara terperinci.

“Apa yang terjadi kepada sistem perundangan negara pada masa sekarang mesti diberitahu kepada orang ramai,” tegasnya.

Menurutnya, adalah menjadi tugas KeADILan untuk mendedahkan setiap maklumat yang diperolehi kepada orang ramai.

Pendedahan dan tayangan video sepanjang lebih 8 minit itu dibuat dalam satu sidang media khas di pejabat Anwar di Petaling Jaya.

Turut hadir Bendahari Agung KeADILan, William Leong serta pegawai-pegawai khas Anwar termasuk Nathaniel Tan dan Sim Tze Tsin.

And then Tan Sri Dzaiddin said he is going to recommend six people for the court of appeal, but until today the letter hasn’t come to PM. He never discuss, but neither he has sent the letter to PM. Yes he has not sent. I know it is under the constitution for judges all that is your job Datuk to send, but we don’t want to make it an issue now.

Ah. Ok Actually I told tengku adnan to inform PM, PM to call you for a meeting. I organize it so that Tengku Adnan will call you directly. And then I got your number, I will tell him to call you directly to for you to meet PM lah. So should be ok, then ar.. correct correct, it is very important that the key players must be there.

Correct x3. correct x2. You know that the same problem that Tun Eusoff Chin has. He tried to do all this and yet he has run out of soldiers. He couldn’t do it because many are from the other camp. Last time was unfortunate because Tun Daim was doing everything sabotaging, otherwise how are things with you - everything is ok?. No, don’t worry. You know sometimes Tan Sri Vincent that half the time they are talking about judiciary rather than doing the work. But if I don’t do this part my work will be useless.

And you know why, actually, I am very grateful with Tan Sri Vincent Tan you know why, I brainwash you so much even I quarrel with him. All these people Tun Eusoff Chin, Datuk Ahmad Fairuz, Tan Sri Zainon all fought for that. Then he called Tengku Adnan. Tengku Adnan he said, saya bukan Perdana Menteri Malaysia lah, you know. If the old man doesn’t want to listen to me, go to hell.

He quarreled with me. I said nevermind, nevermind, you talk to PM again tomorrow morning to put Datuk Ahmad Fairuz to CJM. So next day morning he went and he called me back 9.30 that he said PM has already agreed. So I said nevermind, we hope for the best. So I said no harm trying, the worst that it can happen is that you lose. Being the old man, he is 76 years old, he gets whispers everywhere, and then you don’t whisper, he get taken away by the other side. But, now PM is very alert because every time he gets letters from Tan Sri Zaidin, he called Tengku Adnan, he said discuss with Vincent, come and discuss.

Yes yes, ya. Correct x2, ya, but you see although I know PM, I am a lawyer in practice my views are.. I go through them, I go through them lah. Ah x4.

And then Zaidin will call them telling that you went saw PM and you make a big issue out of it. Oh ya, I think so, I think so.

Ah x2 correct x2. Now I heard Raja Aziz, Raja Aziz huh, spoke to my lawyer Thayalan, and another lawyer Ailan, in the high court, they have a case each other. So, Thayalan and Ailan asked Raja Aziz, how is Tan Sri Wan Adnan?

He said he is on his way down. But you know what is the shocking thing he said? Datuk Fairuz became CJM. He overruled everybody, in three months time, he is going be made VCA, and 6 months time he is going to be CJ. He said he cant think he shocked. He told us.

Ha, it seems that they are going to organize a campaign to run you down. But you just keep quite don’t say anything. Even the press asked, you said I leave it to God, that’s all. Don’t say. I really like your message. You said you work very hard, what can I do? I leave it to God.

That’s the best answer datuk that you can ever be.

Ah… I will also get Tan Sri to remind PM to put a Tan Sri ship this year lah. This will elevate you, you know.

Oh yes x4. ha. XX got so fast, Tan Sri Chong waited for whole year to get Tan Sri Ship.

Don’t worry, we organize this. If Tan Sri Vincent and Tengku Adnan want to meet you privately, they will, I will call you. We organize in a private arrangement, in a very unusual place.

No don’t worry, Datuk, I know how much you suffer for Tun Eusoff Chin. And Tun said Datuk Ahmad Fairuz 110% loyalty. We want to make sure our friends are there for the sake of the PM and the sake of the country.

Not for our own interest, not for our own interest. We want to make sure the country come first. Well, you suffered so well, so much you have done. For the election, Wee Choo Keong, everything. How much, no body would have done all these.

RAJA-RAJA TOLAK CALON KETUA HAKIM MALAYA



Majlis Raja-Raja dalam Mesyuarat Majlis Raja-Raja bulan lalu mengambil satu tindakan yang tak pernah dilakukan menolak calon Ketua Hakim Malaya yang dikemukakan oleh kerajaan Paklah.

Laporan Straits Times pada 07 Ogos 2007 seperti berikut,

M'sia's sultans refuse to endorse govt's candidate for key judicial post KUALA LUMPUR - MALAYSIA'S sultans have refused to endorse the government's candidate for a key judicial post, setting the stage for a possible impasse between the rulers and administration.

The Conference of Rulers last month asked Prime Minister Abdullah Ahmad Badawi to reconsider the candidate named for the post of Chief Judge of Malaya (CJM), the third highest-ranking official in the judiciary.

The Constitution requires the Prime Minister to 'consult' the Conference of Rulers, comprising the nine hereditary rulers, and their highly unusual move to withhold approval has created a stir among members of the legal fraternity.

The position of CJM has been vacant for seven months since Tan Sri Siti Norma Yaakob retired in January. There are currently eight judges in the Federal Court who qualify for appointment.

Under the Malaysian constitution, the rulers are to be consulted on certain key government appointments such as judges or members of the Election Commission.

In the case of judicial appointments, the Prime Minister makes the recommendations after discussion with the Chief Justice.

However, while they rarely reject recommendations, the Conference of Rulers has always been active in debating judicial appointments.

One of its most senior members, Sultan Azlan Shah of Perak was head of the Malaysian judiciary in the 1970s.

PM Abdullah is believed to have met with the Perak Sultan over this matter.

Legal opinion is divided on whether the rulers' refusal to accept the candidate will stymie the appointment.

The Constitution is silent on this point, while in the case of Bills passed by Parliament, it states that they automatically become law after 60 days if the Rulers withhold assent.
